General terms and conditions of sale

These Terms and Conditions apply, without restriction or reserve, to all sales of Products offered by the LE COUVENT brand agreed with consumers solely via the website www.lecouventdesminimes.com.

They may be printed out and kept by the Customer.

Consequently, the fact of a Customer ordering a Product offered for sale on the website www.lecouventdesminimes.com implies full and unreserved acceptance of these Terms and Conditions, which the Customer declares that they have read before ordering.

In accordance with article L.111-1 of the French Consumer Code, the Customer can find information about the essential characteristics of the Products they wish to order on the website before ordering.

PRODUCTS

The Products offered for sale on this website at the address www.lecouventdesminimes.com constitute the offer from the brand LE COUVENT. LE COUVENT reserves the right to modify its collection at any time and change the list and ranges of Products. The photos of the Products presented on our website are not binding. However, LE COUVENT does its best to ensure the photos and drawings faithfully represent the products offered and do not introduce ambiguities about aspects such as dimensions, weight or quality.

CUSTOMER

LE COUVENT offers its Products for sale via the website www.lecouventdesminimes.com to consumers with the legal capacity to place an order (hereafter referred to as the "Customer"). LE COUVENT is not responsible for verifying the legal capacity of each Customer.

PRICES

The sale price of each Product stated in euros is the price in force when the order is placed. These prices do not include shipping costs, which are billed in addition to the prices of the Products purchased in accordance with the terms below, as indicated to the Customer before the order is confirmed. The prices include the value added tax applicable on the date of the order.

Offers presented by LE COUVENT are valid as long as they are announced on the site, subject to availability. Where relevant, information about Product availability is presented when the order is placed.

TO ORDER

LE COUVENT allows you to order by the method of your choice to ensure you are satisfied.

On the website, payment can be made solely by credit card, Mastercard, Visa, debit card or PayPal.

The Customer can check the details of the draft order and correct any errors.

As soon as the Customer confirms the order by clicking the finalise button, they are considered to have given their fully informed consent to the content and terms of the order and, in particular, these Terms and Conditions of Sale, the prices, volumes, characteristics, quantities and shipping times for the Products offered for sale and ordered by the Customer.

The sale becomes final when the order is confirmed by the Customer, without prejudice to the Customer's right to withdraw. The order is confirmed by LE COUVENT in an electronic mail to the Customer summarising all the information previously provided by LE COUVENT.

A second electronic mail is sent to the Customer when the order is shipped.

LE COUVENT recommends that the Customer keeps these two electronic mail messages on paper or in electronic form. The Customer is informed that the two electronic mail messages will be sent to the electronic mail address provided by the Customer as part of the identifying details supplied before placing the order. LE COUVENT cannot be held liable if the electronic mail address entered is incorrect or the electronic mail confirming the order is not received.

LE COUVENT is entitled to claim the full amount of the price corresponding to the order as soon as the electronic mail is sent informing the Customer that the order has been shipped.

GIFT WRAPPING OF PRODUCTS

If the Customer wants, LE COUVENT can provide gift wrapping for a fee of €2.

DELIVERY

Delivery location

  • LE COUVENT only delivers Product parcels in mainland France (including Corsica and Monaco).

  • Products will be sent to the delivery address the Customer provides during the ordering process.

  • The contribution to delivery costs includes all taxes.

Product delivery time

  • The maximum delivery time is 30 working days from the order confirmation date. As a guide, the average delivery time from receipt of the shipping confirmation email is estimated at two working days for items in stock, excluding preparation time (average of two to four working days), but this is not a binding target.

  • For Corsica: The shipping time can be extended by one or two working days.

  • These times apply if you place your order before 12 pm and the Product is in stock.

Product delivery terms

  • FRANCE – STANDARD FRANCE & ACCESS – Presentation WITHOUT signature

  • The contribution to delivery costs is €5. This price applies to deliveries in mainland France only (including Corsica and Monaco).For delivery in other countries, the cost may vary. 

  • Standard delivery is free for all orders of €75 or more. The guide delivery time provided by La Poste (the French post office) is 24 to 48 hours after LE COUVENT makes the parcel available to La Poste. The recipient can track the parcel using the parcel number sent by email, or by contacting the Customer Services department.

  • The parcel is posted directly through the letterbox at the delivery address. If the letterbox is not large enough, the parcel is given in person either to the order addressee or, at the initiative of La Poste, to anyone else present at the address who agrees to receive the order (a neighbour, caretaker or attendant). In this case, the details of this person will be provided on a notice posted through the letterbox at the delivery address.

  • If the parcel could not be delivered under the terms above (absence of the addressee), a delivery failure notice is left by La Poste in the addressee's letterbox, indicating the details of the nearest La Poste office, where the addressee can collect the parcel within 14 days on presentation of an identity document and the delivery failure notice. If the addressee does not collect the parcel within the time stated by La Poste, the parcel will be returned to our warehouse at the Customer's expense. The Products ordered will be either reimbursed or re-shipped.

  • No disputes about the delivery itself will be accepted if the parcel is listed as having been delivered, and the La Poste IT system (parcel scanning) is considered to constitute proof.

Delayed Product delivery

  • If a Product delivery is delayed more than 30 working days after the latest delivery date indicated when ordering, the Customer can cancel their order with the LE COUVENT Customer Services department no more than 60 working days after the latest delivery date indicated when ordering, unless the delivery delay is the result of a case of force majeure.

  • LE COUVENT accepts payments by debit card, Visa, Mastercard and PayPal

Security

  • Bank card payments via this website use a secure payment system. This website secures your confidential information with an SSL Digicert certificate. The information exchanged is encrypted with SSL (Secure Socket Layer) before transmission. As the information is not legible, no-one can use it without your knowledge.

  • To increase the security of your bank details, LE COUVENT does not conserve this information. This is why you must enter it again for each subsequent order.

  • LE COUVENT reserves the right to suspend or cancel any order and/or delivery if the Customer fails to pay or if there is a payment problem and/or fraud in the use of the site or the payment method chosen by the Customer.

Retention of title

  • LE COUVENT retains ownership of the Products delivered until the full price is paid.

Liability

  • LE COUVENT undertakes to fulfil the obligations arising from the contract. However, LE COUVENT can absolve itself of some or all of its liability by proving that the non-fulfilment or incomplete fulfilment of the contract can be ascribed either to the Customer or, unforeseeably and unavoidably, to a third party to the contract, or to a case of force majeure (e.g. strikes, accidents, riots, fire etc.) constituting an unforeseeable event.

  • LE COUVENT cannot be held liable for disruption or damage resulting from the use of the Internet.

Transfer of risk

  • The risk of loss or damage to the goods is transferred when the Customer or a third party appointed by the Customer, other than the shipper proposed by the professional, takes physical possession of the goods.

RETURNS & REFUNDS

Product availability

  • We do everything we can to ensure our Products are available. Product offers are valid as long as they are announced on the site, subject to availability.

  • Information about Product availability is presented to the Customer when the order is placed. If a Product in an order is not available when the order is prepared, LE COUVENT will send an email to the Customer. The Customer may then:
    - Receive the rest of the Order without the Product out of stock, whose price will be deducted from the order total and not billed to the Customer (except for free Products)
    - Cancel the whole order.

Legal Product guarantees

  • LE COUVENT respects all its legal obligations with regard to guarantees, including the guarantee of conformity with the contract specified in articles L211-4 et seq. of the French Consumer Code and the warranty against hidden defects specified in articles 1641 et seq. of the French Civil Code.

  • In the event of a conformity defect (product not suitable for the purpose usually associated with such a product, not corresponding to the description given by the seller or the public statements made by the
    seller or defined by mutual agreement between the parties) or hidden defects (hidden defects in the thing sold that render it unfit for its intended use, or that so impair its use that the buyer would not have bought it, or would only have given a lesser price for it if they had known of the defects) in the Product, in compliance with the conditions set by the law, complaints must be sent in the first instance to LE COUVENT by post to the following address: LE COUVENT – Customer Services Department – 79, rue de Miromesnil, 75008 Paris – FRANCE

  • In the event of a conformity defect, LE COUVENT will replace the Product with the same product or an equivalent. The replacement will be made within no more than one (1) month from receipt of the Product.

  • LE COUVENT reminds its Customers that LE COUVENT Products must be protected against humidity, high temperature and intense light and may be subject to a best-before date. Products not conserved under these conditions are thus excluded from the guarantee.

Returns & exchanges

  • LE COUVENT invites Customers wishing to return or exchange a Product to contact the Customer Services department, who will advise them how to proceed.

  • If there is an anomaly in the content of the order, LE COUVENT invites the Customer to contact Customer Services directly.

  1. Return under the right to withdraw

      • The Customer has the right to withdraw from this contract without giving a reason within fourteen days.

      • The withdrawal period expires fourteen days after the date when the Customer, or a third party appointed by the Customer other than the shipper, takes physical possession of the Products.

      • To exercise the right to withdraw, the Customer must inform LE COUVENT's Customer Services department, 79, rue de Miromesnil, 75008 PARIS of their decision to withdraw from this contract in a clear, unambiguous declaration (such as a letter sent through the post, a fax or an electronic mail message). The Customer may use the withdrawal form template by clicking HERE.

      • To respect the withdrawal deadline, it is enough for the Customer to send the communication about exercising the right to withdraw before the expiry of the withdrawal period.

      • If the Customer withdraws from this contract, LE COUVENT will refund all payments received from the Customer, including shipping costs (but excluding additional costs, where relevant, arising from the Customer's choice of a more expensive shipping method than the standard delivery offered by LE COUVENT) without excessive delay and no later than fourteen days from the date when LE COUVENT is informed of the decision to withdraw from this contract. LE COUVENT will carry out the refund using the same payment method as the Customer used for the initial transaction, unless the Customer expressly agrees a different method; the refund will never result in additional costs to the Customer. LE COUVENT may delay the refund until LE COUVENT has received the Products or until the Customer has evidence of having sent the Products back, whichever date is earlier.

      • The Customer must send the whole order containing the Products to the following address: DUHAMEL LOGISTIQUE – Site n°9, ZA Les Vignettes, Voie Communale 7, 27690 LERY, without excessive delay and no later than fourteen days after communicating the decision to withdraw from this contract. This period is considered to have been respected if the Customer sends the Products before the end of the fourteen-day period.

      • The Customer is responsible for the direct cost of returning the Products.

      • The Customer is only liable for Product depreciation due to handling other than what is necessary to determine the nature, characteristics and proper functioning of the Products. All Products must be returned to LE COUVENT in their original packaging and condition. LE COUVENT has a period of four (4) days from receipt of the returned order to check the condition of the Products.

      • For cosmetics Products, and for health and safety reasons, the Customer is nevertheless clearly informed that the right of withdrawal does not apply to any cosmetics Products that are unsealed after delivery.

      • For Cosmetics products that are unsealed after delivery, given that the right of withdrawal does not apply to these Products, LE COUVENT:
        - will never refund the full payment (including the Customer's shipping costs)
        - will demand a refund of all payments (including the Customer's shipping costs) if LE COUVENT has already refunded all the payments received from the Customer.

      • If there is a problem, LE COUVENT invites the Customer to contact Customer Services directly and solely.

  1. Return under legal guarantee

      • LE COUVENT invites Customers wishing to return or exchange a Product to contact the Customer Services department, who will advise them how to proceed and issue a return slip to be completed.

Jurisdiction

  • Sales of Products via this website are subject to French law, regardless of the Customer's country of residence or the order location. Any disputes about the existence, interpretation, execution or termination of a contract between the Customer and LE COUVENT are subject to the exclusive jurisdiction of the French courts.

CONFIDENTIALITY AND PERSONAL DATA PROTECTION

  • Our Internet server automatically recognises the domain names (of the ISPs) and, where possible, the email addresses of web users who visit our site. We centralise the domain names for statistical purposes. We use the information provided to improve the content of the pages of our site.

  • LE COUVENT collects and processes personal data about the Customer and the recipient of the order (except for credit card numbers) in electronic form solely for the purpose of managing orders. In accordance with the French data protection law of 6 January 1978, the Customer has the right to access, correct and object to the storage of personal data held about them, which can be exercised by sending an email to hello@lecouventparfums.com or a letter to:

  • To improve the performance of the site and the use you make of it, LE COUVENT and its authorised service providers may use audience measurement and navigation monitoring tools (such as cookies, tags etc.). We inform you that you can refuse the storage or use of these tools by the way you set up your browser.

AMENDMENTS TO THESE GENERAL TERMS AND CONDITIONS OF SALE

  • LE COUVENT reserves the right to amend the content or characteristics of these Terms and Conditions of Sale at any time. Each order gives rise to the acceptance of the current version of the Terms and Conditions of Sale.

  • Even if any of the provisions of these Terms and Conditions of Sale are found to be invalid or declared as such in application of a law or regulation or following a final decision by a competent court, the other provisions will remain in force with the same scope.

INTELLECTUAL PROPERTY

  • The companies in the group to which LE COUVENT belongs own all the intellectual and industrial property rights relating to the LE COUVENT website or have the right to use them.

  • Access to this website does not give you any claim to the intellectual property rights relating to the Site, which remain the exclusive property of the companies in the Group to which LE COUVENT belongs.

  • The overall structure of the Site, together with its accessible elements, including text, photographs, animated and still images, icons, maps, sounds, videos, software, databases, data and all the other elements making up the Site, are the exclusive property of the companies in the group to which LE COUVENT belongs.

  • You may never reproduce, re-present, modify, transfer, publish or adapt in any medium by any means or exploit in any way any part of the Site without the prior written permission of the companies in the group to which LE COUVENT belongs. You are informed that this prohibition includes, but is not limited to, practices such as scraping or the use of robots to extract or reproduce any element of the Site, including the product offers it contains, particularly but not solely for commercial purposes.
